Per noi di Ars Elettromeccanica la privacy è un argomento di primaria importanza. E’ per questo motivo che ci occupiamo in maniera rigorosa del trattamento dei dati personali degli utenti (di seguito anche semplicemente “gli Utenti” o “gli Interessati”) che interagiscono con i servizi del Sito www.arselettromeccanica.it (di seguito anche semplicemente “il Sito”, attenendoci strettamente alle disposizioni di legge, previste sia dalla legge italiana (Decreto Legislativo n. 196/2003), sia dal Nuovo Regolamento Europeo 2016/679 in materia di Trattamento e Protezione dei dati personali (GDPR).

1. Chi è il Titolare del trattamento?

Per la sede di La Morra, il Titolare del trattamento dei dati personali, relativi a persone identificate o identificabili trattati a seguito della consultazione del nostro sito, è:

2. Quali sono le finalità del trattamento? E quali sono le basi giuridiche?

a) Per prima cosa, il trattamento dei dati personali degli Utenti è finalizzato a fornir loro un preventivo o altre risposte (via email, telefono o altri canali di comunicazione) alle richieste che essi abbiano avanzato, o ancora adempiere ad obblighi di legge o ordini dell’Autorità. Le basi giuridiche sono la necessità di adempiere agli obblighi contrattuali o precontrattuali cui è soggetta la nostra società, o la necessità di adempiere agli obblighi legali ai quali è soggetta.

b) Il trattamento potrà essere effettuato anche per comunicare agli Utenti l’organizzazione di eventi particolari, novità relative ai servizi o prodotti da essi acquistati o di cui abbiano chiesto informazioni e attività di marketing diretto; oppure per trasmettere dati personali all’interno del gruppo imprenditoriale di cui la nostra società fa parte per finalità interne; o ancora, eventualmente, per tutelarci in caso di contenzioso (di qualsiasi natura), o individuare eventuali attività dolose o fraudolente: in questi casi la base giuridica sarà il legittimo interesse di Ars Elettromeccanica o di terzi.

c) I dati degli Interessati potranno, con il loro consenso, essere infine trattati per inviar loro (via e-mail – anche con newsletter – telefono o altri canali di contatto forniti) comunicazioni commerciali o materiale pubblicitario su prodotti o servizi offerti dalla nostra società; contattarli per offerte personalizzate o rilevare il grado di loro soddisfazione sulla qualità dei servizi e dei prodotti, o segnalare eventi: in tal caso, come detto, la base giuridica sarà il loro espresso consenso.

3. A quali categorie di destinatari potranno essere comunicati i dati personali?

I dati degli Utenti potranno essere comunicati alle seguenti categorie di soggetti:

• soggetti esterni, che svolgono, per conto della nostra società, in qualità di Responsabili del trattamento (vincolati da apposito contratto ex art. 28 GDPR) o in qualità di Titolari autonomi, alcune attività di trattamento (quali, ad esempio, società di servizi amministrativi, commerciali, contabili e fiscali o informatici), necessarie per l’esecuzione delle attività connesse alle finalità già descritte.

• amministrazioni o autorità pubbliche (Agenzia delle Entrate, Autorità Giudiziaria o di pubblica sicurezza, ecc.) per l’adempimento di obblighi di legge. I dati personali non sono soggetti a diffusione.

4. Per quale periodo saranno conservati i dati personali?

Ars Elettromeccanica conserverà i dati per il tempo necessario al raggiungimento delle suddette finalità e comunque non oltre cinque anni, ovvero per i termini maggiori eventualmente previsti dalla legge o dall’ordine dell’autorità (nonché eventualmente per agire/resistere in giudizio). I dati trattati in base al consenso degli Interessati saranno invece conservati fino alla revoca dello stesso.

5. La comunicazione dei Dati è obbligatoria? Quali sono le conseguenze del rifiuto?

La comunicazione dei dati contrassegnati da asterisco è necessaria: il mancato conferimento renderà impossibile al Titolare di adempiere ai propri obblighi, o comunque fornire all’Utente quanto richiesto. La comunicazione dei dati privi di asterisco è facoltativa: il mancato conferimento ci permetterà comunque di adempiere a quanto richiesto.

6. Quali sono i diritti dell’Interessato?

Il Regolamento UE garantisce all’Interessato i seguenti diritti con riferimento al trattamento dei suoi dati personali:

a) diritto di accesso con eventuale richiesta di copia dei dati trattati (art. 15 GDPR);

b) diritto di rettifica dei dati personali inesatti senza ingiustificato ritardo nonché di integrazione dei dati personali incompleti (art. 16 GDPR);

c) diritto alla cancellazione dei dati personali senza ingiustificato ritardo – c.d. ‘diritto all’oblio’ – per uno dei motivi indicati dalla lett. a) alla lett. f) dell’art. 17 GDPR;

d) diritto di limitazione del trattamento per una delle ipotesi indicate dalla lett. a) alla lett. d) dell’art. 18 GDPR;

e) diritto alla portabilità dei dati (art. 20 GDPR);

f) diritto di opposizione, per motivi connessi alla sua situazione particolare, al trattamento dei dati personali che lo riguardino ai sensi dell’art. 6, paragrafo 1, lettere e) o f) GDPR, compresa la profilazione – diritto di opposizione al c.d. ‘marketing diretto’ (art. 21 GDPR);

L’esercizio dei diritti dell’Interessato potrebbe essere ritardato, limitato o escluso nei casi previsti dall’art. 2- undecies D.Lgs. 196/03.

In merito all’esercizio di tali diritti, l’Interessato potrà rivolgersi a Ars Elettromeccanica, tramite richiesta scritta.

Resta infine fermo il diritto di rivolgersi all’Autorità Garante per la protezione dei dati personali, anche attraverso la presentazione di un reclamo, ove ritenuto necessario, per la tutela dei dati personali e dei diritti.

7. L’Interessato può revocare il proprio consenso?

L’Interessato ha il diritto di revocare in qualsiasi momento il consenso eventualmente prestato, senza che tale revoca pregiudichi la liceità del trattamento (basato sul consenso) prestato prima della revoca.

2. What are the purposes of the processing?

The legal bases are the need to fulfill the contractual or pre-contractual obligations to which our company is subject, or the need to fulfill the legal obligations to which it is subject.

b) The processing may also be carried out to communicate to Users the organization of particular events, news relating to the services or products they have purchased or for which they have requested information and direct marketing activities; or to transmit personal data within the business group to which our company is a part for internal purposes; or, possibly, to protect us in the event of a dispute (of any nature), or identify any malicious or fraudulent activities: in these cases the legal basis will be the legitimate interest of Ars Elettromeccanica or third parties.

c) The data of the interested parties may, with their consent, be finally processed to send them (via e-mail - even with newsletters - telephone or other contact channels provided) commercial communications or advertising material on products or services offered by our company ; contact them for personalized offers or detect the degree of their satisfaction with the quality of services and products, or report events: in this case, as mentioned, the legal basis will be their express consent.

3. To which categories of recipients may the personal data be disclosed?

User data may be disclosed to the following categories of subjects:

• external subjects, who carry out, on behalf of our company, as Data Processors (bound by a specific contract pursuant to Article 28 of the GDPR) or as independent Data Controllers, some processing activities (such as, for example, administrative service companies , commercial, accounting and tax or IT), necessary for the execution of the activities related to the purposes already described.

• public administrations or authorities (Revenue Agency, Judicial or Public Security Authority, etc.) for the fulfillment of legal obligations. Personal data are not subject to disclosure.

4. For what period will the personal data be stored?

Ars Elettromeccanica will keep the data for the time necessary to achieve the aforementioned purposes and in any case no later than five years, or for any longer terms provided for by law or by the order of the authority (and possibly to act / resist in court). The data processed on the basis of the consent of the interested parties will instead be kept until the revocation of the same.

5. Is the communication of data mandatory?

What are the consequences of refusal? The communication of data marked with an asterisk is necessary: ​​failure to provide it will make it impossible for the Data Controller to fulfill its obligations, or otherwise provide the User with what is requested. The communication of data without an asterisk is optional: failure to provide it will still allow us to fulfill what is requested.

6. What are the rights of the interested party?

The EU Regulation guarantees the interested party the following rights with reference to the processing of his personal data:

a) right of access with any request for a copy of the data processed (Article 15 of the GDPR);

b) right to rectify inaccurate personal data without undue delay as well as to integrate incomplete personal data (Article 16 of the GDPR);

c) right to cancel personal data without undue delay - so-called 'Right to be forgotten' - for one of the reasons indicated in letter a) in letter f) of art. 17 GDPR;

d) right to limit the processing for one of the hypotheses indicated by lett. a) in letter d) of art. 18 GDPR;

e) right to data portability (Article 20 of the GDPR);

f) right to object, for reasons related to his particular situation, to the processing of personal data concerning him pursuant to art. 6, paragraph 1, letters e) or f) GDPR, including profiling - right to object to the so-called 'Direct marketing' (Article 21 of the GDPR);

The exercise of the rights of the interested party may be delayed, limited or excluded in the cases provided for by art. 2- undecies of Legislative Decree 196/03.

With regard to the exercise of these rights, the interested party may contact Ars Elettromeccanica, by means of a written request.

Finally, the right to contact the Guarantor Authority for the protection of personal data remains unaffected, including through the submission of a complaint, where deemed necessary, for the protection of personal data and rights.

7. Can the interested party withdraw their consent?

The interested party has the right to revoke any consent given at any time, without this revocation affecting the lawfulness of the processing (based on consent) given before the revocation.
